Article ContentFailings of C-45 New Veteran Charter

The attached document clearly shows how out of touch VAC Minister Greg Thompson is with the reality of what is going on in the lives of Disabled Veterans. Legal actions against the government will continue until we are treated with the respect, dignity, and loyalty, from the Government of Canada, that we, Disabled Veterans Of The Canadian Forces, are due!!!

Correction To Analysis of C-45
The correction is, since the implementation of the NVC in Apr 06, SISIP can no longer provide free medical coverage to members with less the 10 years service.  Before the NVC, SISIP provided Major medical coverage that mirrored the PSHCP to any SISIP clients who were released with less than 10 years service, because they could not qualify for PSHCP at all.  There were no premiums for this service and because it mirrored PSHCP it covered members and families, indeed the only thing it did not cover was the optional Dental program offered through the PSHCP.  When the NVC kicked in VAC then took responsibility to provide health care to releasing members, specifically those with less than 10 years service, since those with more than 10 years service could apply directly to PSHCP.  The problem that has developed is application through VAC for PSHCP can only happen after release and PSHCP has a mandatory 60 day waiting period so even if the application was completed and submitted on the day of release the member must wait at least 60 days with no extended health coverage.  Of course any delays in application would just further extend the time for coverage to kick in and in order to qualify for VAC support to get PSHCP, the member must qualify for their Rehab program.  In a nut shell the members not only lost pensions for lump sums but they also lost free major medical coverage for extended periods of no coverage and once it does arrive they have to pay premiums for it.
From an A-1 source (correction has been verified; source is very reliable and trustworthy.
Failings of C-45

The attachment includes letters (dated May 11, 2006 & August 4, 2006) from Dr. Keith Martin, MP Esquimalt Juan de Fuca and VAC Minister, Greg Thompson. It also includes a very detailed analysis of the New Veterans Charter, ""Failings of C-45"" which not only enforces my position on how terrible the New Charter is, but in para #3, it also enhances and strengthens our legal position for, ""Manuge vs Her Majesty The Queen."" Section 15.1 of the The Charter of Rights and Freedoms"" Veterans under the Pension act & Veterans under the New Charter are treated differently, despite having the same disabilities.

15. (1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

I would encourage you all to share this information with everyone you know and ask them to write a note to their MP asking for a public commission of inquiry into DND Release, VAC pension act vs New Veterans Charter, and of course our illegal friends, SISIP-Manulife.

When we get to tell our stories to the nation with the Cameras rolling, God Help the Sitting Government.

Thank you for your efforts, Dr. Martin! Also I want to congratulate Mr. Peter Stoffer, MP Sackville Eastern Shore for his convincing win last evening! Mr. Stoffer will be knocking down your doors, Minister MacKay and Minister Thompson. Mr. Harper is too good to talk to us directly and Minister Thompson is just afraid!

I am inviting you Ministers to the negotiating table immediately to discuss settlement in my class action, the SISIP Clawback. Please contact my counsel anytime at McInnis Cooper in Halifax. Mr. Peter Driscoll can be reached at (902) 444-8451 or peter.driscoll@mcinnescooper.com . Remember there is only about 6200 of us! We would like to get on with our lives.

Please Note: The $300 million Stephen Harper just spent on this election that got him nowhere would have just about covered the cost of fixing the SISIP Clawback of Veterans Disability pensions.

Always your loyal and devoted veterans advocate
